What is EB-3?

Eligibility

The basis for a number of immigrant visa types is employment. Your qualifications for a particular form of employment-based visa will be based in part on your education, abilities, and work history.

Skilled Personnel

You must be able to show that you have at least two years of training or work experience that is neither transitory or seasonal. training might include relevant postsecondary education;

You must be doing work for which there are no eligible candidates in the United States; and

A permanent, full-time employment offer and a labour certification are necessary.

Professionals

You must be able to prove that you have a U.S. bachelor’s degree (or a degree equivalent from another country) in the field of the career and that this degree is the standard prerequisite for admission into the field.

A bachelor’s degree cannot be replaced by education or experience;

You must be doing work for which there are no eligible candidates in the United States; and

A permanent, full-time employment offer and a labour certification are necessary.

Unskilled Worker (Other Workers)

You must be able to undertake unskilled work that is either temporary or seasonal, requires less than two years of training or experience, and for which there are no suitable workers available in the United States; and

A permanent, full-time employment offer and a labour certification are necessary.
